Damaged Laptop from ebay seller

Won a "Working" laptop on ebay from a seller. When it arrived it will not power on with power cord or battery. Was packaged very poorly in a Priority Box measuring 14 x 12 x 3.5 inches. Laptop measures 14 x 10 x 1.5. She also forced the 1.5 inch thick power adapter into the box on top of the laptop. The laptop only had 3-4 layers of the tiny 1/4 inch thick bubble wrap around it. The ends of the laptop were unprotected as they measure the same length as the shipping box. I asked her before she shipped it to please package it carefully and I also purchased insurance. I took it to the post office and they said due to incorrect packaging that the insurance would not cover the damages. She refuses to refund me and even stated she will not refund me cause she did not want stuck with a broken laptop and be out 305.00 dollars. She has threaten to report me to the authorities as I am begging her to work with me on this and she is trying to cut off all forms of contact and says I am harrassing her. I am out 328.00 dollars and left with a broken laptop and she will not refund. She said it is not her problem and that it was damaged in shipping and not her responsibility. I have reported her to ebay, left negative feedback, and filed an escalated claim with paypal. I am covered under Paypals Buyer's Protection but that does not guarantee I will get my full 328.00 (includes shipping). According to her service tag number she still has a warranty on this laptop, but I can not have access to it as she is listed as the owner and I don't have her information to transfer owner ship. What can I do? Very upset.
