Question Suspended On Ebay

Hello this is for anyone who can answer especially an attorney.

I was suspended by Ebay for a report of selling stolen property.
I was investigated by the local police and cleared of stolen property charges.
Ebay had no right to suspend me based on suspicion alone.
After I had proof that charges of stolen property were dropped, I notified Ebay.
They asked for proof, I faxed in documentation showing proof.
Because I faxed myself, and not law enforcement (why by the way stated two things, one is that its normal for them to fax the case details once closed - mine has been closed since 9/2008. Two is that I dont think they faxed anything after 9/2008). So since I was the person faxing, not law enforcement, they suspended me indefinitely citing Ebay Abuse:
Here is the quote from the email:
"We have reviewed your account(s) and based on the details of this
situation, have elected to keep your account(s) suspended. Our User
Agreement affords us the right to refuse service under certain
circumstances, as outlined in the 'Abusing eBay' section:

"Without limiting other remedies, we may limit, suspend or terminate our
service and user accounts, prohibit access to our sites and its content,
services and tools, delay or remove hosted content, and take technical
and legal steps to keep users off the sites if we think that they are
creating problems, possible legal liabilities, or acting inconsistently
with the letter or spirit of our policies."

As such, we will no longer be entertaining appeals to this action.
Although future emails from you will be read, should they contain no new
information to review, we may not respond."

Are there anything legal option that I have in a further appeal process.
I mean they shouldve never suspended me yet they did. Once the charges were dropped, and this was proven to be true I should have been reinstated, instead I get this.

An on another note, there was an Ebay who was investigated the same way that I was. He was never removed from Ebay during the investigation. Not only was the person charged w/stolen property, he pled guilty & is awaiting sentencing. He is STILL on Ebay, without repercussion.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to the state attorney general's office. World Law attorneys could also become directly involved, though they normally do charge a fee for that.

you could file a suit but it would be pointless ebay is a private company and like any private company can refuse service they are not obligated to let you sell on their site
