Ripped off on Ebay Telescope Purchase

Hi,

I am hoping a lawyer can help me determine if I have a case. I bought a used telescope on Ebay, listed as being in Mint condition. The price was almost $2000, and the seller shipped it to me (in Georgia) from Colorado. It arrived with a smashed power supply, but otherwise looked OK.

Rather than go through the hassle of making a claim against UPS, I bought a new power supply for 60 dollars. It was only then that I realized the scopes tracking computer was faulty.

I contacted the seller, who insisted it was working when it left his house, and claims UPS damaged it. I filed a claim with UPS, they came out and inspected the package, but will not talk to me b/c I am not the shipper.

I strongly suspect the seller pocketed the 1800 dollar insurance value and is refusing to send it to me.

Can I sue the seller to collect for my loss? The scope is useless as is, and the seller is not responding to emails.
