misuse of funds/ non profit organization

In our Florida non profit organization, we have 4 separate funds set up per our rulebook to be used for different purposes. Over the past few years, the funds have been raided and used for daily operating expenses without a vote or explanation to our board or members. This has been done by executive committee approval only. The entire board was never informed. Is this a case of mishandling membership monies? Does Duty of Care pertain to this?

It is if it violates the agreed fund rules. Officers and directors could in theory be held liable for those funds.
