Illegal Election-Incorporated Association

The Association I am involved with is a non profit charitable organisation
consisting of only volunteers. It is a Queensland wide association. Members
believe that an illegal election was performed at the AGM. There has been a
lot of upheaval because of this.

Two nominees were nominated. The first had his nomination form in 14 days prior to meeting. He had not signed indicating that he had not accepted the nomination. The 2nd nominee was nominated on the day, and was voted in by the members. The first nominee contested this saying his was the only legal nomination, and is now in the position after threatening legal action against the new inexperienced national committee. My question is, which one has the legal right to hold the position under the Associations Incorporated Act?
