Vacant Neighbors tree
A two story tall tree next door is 5 feet from the property line. The branches are touching my home and the roots are damaging my foundation. I am also worried the tree will fall in a windstorm and damage my home. The house is vacant and for sale. I notified the neighbor anyway in writing and the letter was returned with "no forwarding address." I also cc'd the letter to the realtor and our Housing Association, but have not heard back. In my letter, I offered to cut the tree down at my expense. Owner would be responsible for root and limb removal. Am I within my rights, having served notice, to enter the property and cut down the tree? Branches? I live in Virginia. New law recently seems to protect the aggrieved homeowner, me. I love trees, but.... What does this forum think? |
