road maintainance agreement
The deeded wording is "Common law joint road maintainance obligations" and involves 5 land owners along a private road in Haywood county in North Carolina. When I purchased this property which is a rental, the road was dirt with very little gravel on it. Two other property owners bought their property at about the same time. One of these people has decided that we should all chip in to gravel the entire road completely covering the underlying dirt. They say because the common law road joint maintainance agreement is in place that we all have to share the cost of about $500-$1000 a piece. At another rental I own we chip in money to fill the pot holes with gravel and have not covered the entire road. Obviously, my question is "Am I financially obligated to participate in the complete graveling of this road as road maintainance?" How would I handle this without going to court? Ofcourse I am willing to fill pot holes or participate in a less expensive road maintainance alternative.

You don't have to agree to improvements normally. If you don't agree and don't pay there may not be much they can do.
Check the complete terms carefully however to make sure there are not other provisions. |
