Default Tree removal and damage

I have a sticky situation that I was wondering if I could get some input on.

I had some guys remove about 22 pine trees from my yard over a span of a few days. These guys did my mom's hard and she didn't have a problem with them. In fact I didn't until they dropped a tree on my neighbors fence and bent the top rail. They did replace the rail, however not in teh best way since they did not have anything to cut it so a part did overlap. This was Wednesday and tonight (Friday) our neighbor came by and said they had cut it to short and that it needed to be fixed. I know for a fact that the tree removal guys didn't cut it to begin with. I know my neighbor cut it and made a mistake and is now expecting us or the tree removal guys to replace it again. Is this fair? Knowing that it was fixed and the neighbor messed it up, do we have any liability for this? I don't think this is right but I don't have any proof other than my word, my fiances, my dad and the tree people against my neighbor.

I didn't get pictures once they fixed it, my error but I did get pictures of the initial damage. My faince wants to just get it fixed, either the tree people or we pay for it because he doesn't want out neighbors mad at us. I personally want to call him out. I am not sure what to do but the tree people are coming out tomorrow to look and clean some of the mulch up.

Default Re: Tree removal and damage

If you can convince a small claims judge that he is lying then take the issue to court!

Or if you feel he cannot prove his claim!
