WE BOUGHT A HOUSE THAT AT ONE TIME WAS PART OF A FARM. LAST YEAR OUR SON RUINED A SMALL SECTION OF HAY FOR THE MAN THAT NOW OWNS THE FARM. HE HAS LET THE OTHER TWO FAMILIES (AND US,) THAT HAS LIVED HERE MOW AND USE A SMALL AREA THAT IS BORDERLINE TO THE HOUSE AND LOT. WE TRIED TO PAY FOR THE HAY AND MAKE THE SITUATION RIGHT BUT, HE ACTED LIKE OUR SON HAD DESTROYED THE WHOLE FIELD. TO MAKE A LONG STORY SHORT A COUPLE OF WEEKS AGO WE GET A LETTER FROM HIS LAWYER SAYING WE WERE TRESPASSING ON HIM. WE REMOVED OUR PICNIC TABLE AND SWING THAT HAD BEEN THERE SINCE WE MOVED HERE. NOW WE HERE THROUGH GOSSIP THAT HE IS GOING TO DIG UP OUR SEPTIC TANK ,THAT WE JUST FOUND OUT, IS ON HIS PROPERTY. SINCE THE TANK WAS PUT IN WHEN THE FARM AND HOUSE LOT WERE ONE PROPERTY CAN WE FIGHT THIS? THE TANK WAS PUT IN FOURTY YEARS AGO OR BETTER.

Yes. You can argue he knew of it and allowed it to be built there. And then try to sue him for damages. Even the threat may cause him to compromise with you.
