Confused Border Fence Trouble

The border fence my neighbor set up landed on my side of the yard. I have talked to her and written to her and tried to fix it with no success. As I found out from couple contractors that it does not cost a lot to remove the fence (as it is vinyl fence) and reuse it to set up the border line properly. If my neighbor still doesn't talk to me or act upon it, do I have the right to hire the contractor to fix it without her consensus?

You can do anything you wish if it is on your property. But try to be reassonable first and work it out--then act.

If my neighbor agrees to sign an acknowledgement that her fence was mistakenly set up on my property, how long can the signed agreement be valid for? Does it need to be notarized? If either party decides to sell the houses, can I enforce her to correct the mistake then? Also, do I have to have a lawyer to draft up the document in order for it to be legally effective?

My other concern, as it is what she concerns right now, is the gate. She has the gate custom made to match the fence; she is reluctant to correct it right now because of that. I will have to go through the same pain worrying about the gate if we don’t correct it right now before my side of the gate is attaching to it. Any suggestions to what to best handle this situation?

You can make an agreement for as long and under the terms you wish. A simple letter agreement is fine. Notarizing does help to show all realize it is important.
