Confused Neighbor putting water on our property

My brother and I own property in Saunders County, Nebraska. My brother's home is on a hill. His neighbor (directly behind him and higher on the hill) has a geothermal heating and cooling system. Essentially, this system draws water from a deep well at a constant temerature. The water is then run through a heat exhcange unit to extract heating or cooling (depending on the season) and then the water is discharged. While most people who use these systems either return the discharged water to the ground via another well or discharge it into a pond, this neighbor just dumps it outside. Consequently, it runs downhill onto my brother's property causing a swampy mess. Basically, it is as if someone left a garden hose on all year. The neighbor argues that the water is flowing through the same area that storm water flows and so it is alright. We disagree. We don't have a problem with storm water, we do have a problem with someone intentionally putting water on our property because he is too cheap to dispose of the water correctly.

Is there anything we can do to stop this?

A judge will order him to correct the problem, or you could just sue for the damages in small claims court. Warn him and he may compromise
