Default More Driveway Easement ...

I have a Crescent driveway. <-- In one end and out the other. -->
I can turn around and usually do when needed, but at times it is easier to use when using a larger truck and whatnot.

One end is the main part of my driveway and property, but the other end crosses over the paved area of my neighbours. This is only by a meter or two by the Main Road in our town, but I do have to cross it to use this portion of my driveway.

This was built by the previous owners of both houses as near as I can tell (we are both the new owners of these properties)

Do I have the right to use this?

Sadly, the neighbour has been blocking it off lately with Garbage cans and Yardwork. I'm hoping for my sake and all that is good in people that this is an oversight, but it's looking more and more like they don't want us crossing this few feet onto the road.

If both homes had been using it for some time then you could try to claim the right but normally if it is not your property they can request you not use it. It is by far better to come to agreement on this and not let it be a source of conflict. If they don't want you to use it then don't or get a court to say it is okay/

We've never met, but I'm hoping it's more of an oversight.
Conflict like this is silly, but there are a lot of fickle people out there.
