Default Neighbors below me: Do I call the police for harassment?

I live in an apartment and I've only been here for a couple of months. The day I moved in I had to make a run out of town so my friends were putting my stuff together for me. When I came home a few hours later they told me the guy below was constantly coming over asking for me. I was only in the apartment for a few minutes and he was knocking at my door. He told me that they do not like any noise and want us quiet at all times. I told him I have 3 kids and I can't stay quiet around the clock. The law here is to be quiet after 9pm. My kids are not that noisy but they are small and do run up and down the hallway. They play on the floor in the living room and their bedroom. I have had numerous complaints about noise from these people. I am now about to be evicted because of it. For Christmas I was out of town for a week and I even got noise complaints while I was away. WE WEREN"T EVEN HOME!!!!!!! It is a guy, his wife, his 12 yr old son and his mother in law and it's the mother in law who is making all the allegations. She claims the tv in the master bedroom is on full blast all night long. I don't even have the tv on after 10pm and it's not loud. It's average sound. I am so sick of this but I can't get kicked out. Me and my kids will have no where to go. Do I call the police for harassment? I left the landlord a message but haven't heard back yet.

You can certainly object to the complaints and fight any eviction.

You might see if carpet on the floor would help at all.

Tell the landlord you are not making the noise and cite the complaint given when you were not even there...it would seem all tenants just have to work this out.

Other tenants have no business telling you what is acceptable to them and what is not. If a tenant has a complaint, they are to alert the landlord. That is the scope of their involvement. He is harassing you, and you must file a written complaint with your landlord, citing dates and instances he's harassed you.

And yes, you certainly can fight eviction, if the landlord is merely taking this guy's word without even attempting speaking with you about the problem.

I f the landlord does nothing, stop paying rent until he/she does something. You cannot be evicted and thrown out on the street overnight, especially with children...If the landlord does nothing, just save up your monthly rent and find a new place. It can take six months, even more to be evicted when you have noplace to go. Not only that, if someone calls the landlord for a reference for you, he wont say anything negative cuz he just wants you out!

BAD ADVICE from the last poster.

You cannot simply stop paying rent simply because you don't like the noise of the above tenants. That will only result in getting the OP evicted.

An eviction will be on the OPs record, and they will have a very difficult time finding future housing. With children in tow, that is the last thing the OP needs.

Hopefully, the OP will never read the last poster's comments. If, on the off chance, he/she does, it's only hoped he/she is smart enough to not take such inane advice.

I am an apartment maintenance tech and deal with noise issues from time to time. Being close to management and in the field, I can tell you without any doubt that this person IS harassing you and you do have the right to press charges since they are attempting to interfere with your living space. They have clearly demonstrated a desire to invade your home with their preferences, and have given false testimony about you which is illegal. You should go down there and tell them that you've retained an attorney to handle legal action should they decide to complain unduly about you again, as at that time you will file a suit for harassment, libel and slander.

The post you responded to is over two years old.

Besides which, you gave even worse advice than the previous poster. Confrontations rarely end well and to recommend the OP (or anyone) do so is irresponsible and dangerous.
