Confused neighbor's pine tree hanging over my house

I live in Southern California and I have 2 concerns and 2 questions:

1) my neighbor's (a townhome project) three 70' tall pine trees are hanging over my property (side yard and house) which poses not only a danger/liability (falling pine cones on someone in my household), but also a mess (dripping sap and fallen pine needles).

Is the the Homeowner's Association responsible for trimming them (all logic tells me yes), and, if so, how should I go about notifying them requesting they rectify the situation (certified letter & verbal? timeline to fix?)?

2) The same neighbor's 8' tall and 60' long wall composed of 1/2 cement blocks (lower half) and wood fence (upper half) is leaning toward my sideyard and is unkept. The cement portion of part of the fence is leaning in because of the pressure from the pine tree roots (I'm assumming and it appears so) and the upper wood half is leaning due to unproper supports. Additionally, the wood is weathered--faded, green-stained from their sprinkler system, has areas of deterioration from dry rot and termite infestation. Lastly, apparently when the cement wall was installed over 10 years ago (years before I bought it), the excess mortar/cement in all the seams was not scraped off on my side of the wall, so every seam on my side has 1-2" of mortar seeping out (obviously, hardened).

Is the same HOA responsible for straightening the entire wall, fixing the weathered and deteriorated areas and scraping/chiseling off the excess mortar/cement?

The "person" has legitimate concerns. They deserve an answer, not a smart *ss, infantile comment. And nowhere does it say this person is male or female. Not that it makes any difference. I suggest you not flame others, and that you blog elsewhere. But wherever you go to complain or blog, please do so as adult. Best regards!
