We purchased several acres of land with one side bordered by unoccupied treed land and a bob-wire fence. Our original survey shows my property line inside of the fence by as much as 30' at one point, that was existing at the time we purchased. We did not install the fence, and it is not on the property we purchased. The owner has decided to sell the property and wants us to remove the fence. We refused because 1st it is not on our property, and 2nd we did not install the fence. We are being sued because we refused to remove "someone else's" fence. Do they have a case against us?

If it is on his property he has to remove it. If that is the case.
He will lose. He should have checked that earlier but cannot now hold you liable. |
