My family owned our home for almost 200years. Half was given to my grandmom's youngest sister for a wedding present in the 1950's and she sold it without consulting the family for quick cash. The family that bought it has caused many problems: cutting the main floor beam, water damage, illegally remodeling w/ no permit, throwing garbage & dead animals on our property, taking us to court repeatedly. Now that I'm of age and ready to do battle, how do I prove all of this? I have witnesses, but what laws are there? They've also halted our new addition which has caused further water damage because our roof isn't finished. I'm past being tired of this act to take our property. What can I do?

Keep a good record and compile all evidence, add pictures etc. to prove your point. Then see if they will negotiate. If not then:
If two or more owners cannot agree on what to do with a piece of property they may petition the court and the court will order a sale or refinancing etc. so that the one or more may get out of the property obligation and/or the other(s) may keep it etc.--it is often done-- (This is true in some cases even for equitable owners that have paid various amounts etc., but for various reasons, may not be on title.) You could threaten to take this action if need be. It may cause compromise which is of course what you need here now. |
