HELP. He wants my fence down immediately.
Any help here is greatly appreciated. My neighbor is a menza maniac... they might be smart but sometimes can have no social skills. I bought my home 6 years ago and share a driveway with my neighbor with a right to pass. However he parks a trailor on his "line" so I can't enter my gate. He doesn't want me to use my snow blower because snow hits the house -- I literally have to hand shovel snow and carry it across the street. Keep in mind his house isn't fit for a rat. He does not mow, cut trees, blow, shovel, plant or even sit outside. He is a recluse! I put a pool in 6 years ago which he fought then but I got my variance and the pool has been in. When I bought the house there was an existing cedar fence between us and he's always told me it was on his property. It is. When the surveyors came out for my pool I am a foot or so on his property. Now I removed that fence and put in a lovely white vinyl fence and asked the company to bring it as close to my house and concrete surrounding the pool as possible and thought he'd be happy getting back what property i could give him. NO... he approached me and had the property re-surveyed... the new fence is on his property and he wants it removed IMMEDIATELY. I explained I thought I was being a nice person by moving it over as much as I could and that it cannot come over any further because there is concrete there -- he replied that I needed to CUT the concrete. He is almost impossible.
For six years the concrete has been there, for 20 years the other fence and I simply replaced IT with a nicer fence and moved it in -- He is a real wacky man and he bullies me. I know he's getting a lawyer. I'm sick and losing sleep. What is going to happen here? My fence company says I'm fine -- don't worry something about imminent domain or grandfather clauses etc... HELP and QUICK PLEASE. |

I wouldn't worry about him. Even if he gets a lawyer. you really don't need one. ESPECIALLY in civil court. just do some research. it's as simple as googling your county/city/state laws reguarding zoning, property laws, etc. IF you are worried about your property you can also call the city council and see if there's any laws HE'S violating w/ his property being so 'ugly'. (not mowing, etc). BC it's a danger to UR house for fear of rats, disease, etc. We have one of those ordinances in our county. They will come out and fine him if his property is endangering anyone else's property or health. just call county council. they'll help. also you can ask them about your fence. they'll come in real handy soon. Either way when you go to court i'm sure the judge will look at his attitude and yours and understand how unwilling he is to budge.
DOCUMENT EVERYTHING!!!! Every word he says, you say, phone calls, & the content of the convo. The judge would prob. prefer you do this manually in a notebook also, instead of computer & printing. More reliable. Good luck. |
