Confused Peeping Tom, Voyuer

What type of legal action can I take against a "Peeping Tom". My wife happened to be in our pool with my son at the time and my wife noticed our new neighbor "renter" was standing on something to pear over our separation wall to watch her. Do I notify the police and file a complaint? Do I confront him about it?

You may want to discuss it first. It may have been a one time incident for some reasonable reason.

Perhaps he wondered if the pool was open or enclosed, or safe etc.

If you are not satisfied then you may tell the police.

Talking to him first is always the best option. He may have a rational explanaton although I can't imagine what if he was standing on something for the purpose of looking over the wall

GET A 9mm AND POINT IT AT HIS FACE. IF HE APOLOGIZES, ITS GOOD, IF HE GETS SCARED, JUST SAY YOUR SHOWING IT OFF AND ITS NOT LOADED. IF HE SAYS THAT YOUR WIFE IS HOT IN FRONT OF THE GUN, PULL THE TRIGGER MULTIPLE TIMES. STEP 2 BURY EVIDENCE.
