rights on a private roadway in NJ
Hi We bought own home 2 years ago and we keep being told the neighbor owns the roadway. See back in 1883 or so the #1 lot was sub-divided in to another lot so then lot#2 later in the 1940s sub-divided into 3 more lots but the now owner of lot #2 says she owns the roadway but our deeds say it is a common share drive(to from and behond) So my question is does she own the roadway that was once called the driveway to lot #2 or did they give up that right when the sub-divided into other lots? thanks for you time.

it reads common share, she may own just part of that, the other part is sub.
My parents area, a mans back yard goes out to a small road which many use as a cut through, he demanded that it was his property and wanted to close the road from traffic, it was not his property, and a road like that is not privately owned unless it is legally part of their property. You would need to speak to the zoning board of your town to get the official info on that. See what the zoning statement says for that property. |
