road maintenance issues
I live in a small private community with gravel roads. I purchased my home in june 07 and beginning july 07 we began having pretty severe water problems on the road that provides access to our property. The problem has gotten so bad that it is now affecting our property and three other neighboring properties. The issue with the water is being addressed and the community is attempting to rectify that problem but what has happened is that the water has been so bad that my road has been destroyed. There is no stone left and major holes remain. We have asked that it be repaired but the community is refusing to do so. My question is this. I am supposed to pay dues which are to be used for road maintenance but since they will not repair the road, can I withhold my dues until they agree to the repairs. I wish I were exaggerating the issue but the road was impassible for at least one week this winter and as it thaws, the mud and ruts become staggeringly worse. Our by-laws state the following,"The purpose of the corporation is to insure the safety and maintenance of the roads in the community known as Parkaire Heights". When I say my road, I am referring to the road that is owned by the community, not my private property.
