Default If my fiancé goes to jail, will my perm resident status change?

My fiance has been charged with a crime she did not commit, and is in the process of proving to a grand jury that she is innocent. There is a minor possibility that she may go to prison for 3 to 5 yrs if her lawyer is not able to prove her innocence. She is a doctor and has no past criminal record. My concern is what will happen to my permenant resident status if we get married tomorrow,and they send her to prison in few months? Am I able to continue my case to obtain my green card and go on the interview by myself or not? Am I able to do anything with my alien status while she is absent in prison? and most importantly, should we wait until her case is over to wed?

You can continue it yes; but you will want to have immigration legal counsel involved.

Thank you for your reply. So essentially, what you're saying is that I am able to follow through with the immigration process but I should hire an immigration attorney to protect my rights...? Is that correct, if not please elaborate? Thank you again in advance. Djordje

I think, When your finance is in a dire situation like the one you described. Residency status should be the last in your mind.
