derivation of citizenship through one naturalized parent

hi all;

I am asking this on behalf of my friend so please be nice!

basically I am pretty sure she is but derivation of u.s citizenship through at least naturalized parent the rules are as follows:

* The child must be unmarried;
* The child must be under 18;
* The child must have at least one US citizen parent (by birth or naturalization);
* The child must be currently residing permanently in the US in the legal and physical custody of the US citizen parent
* The child must be a lawful permanent resident of the US; and
* If adopted, the child must satisfy the requirements applicable to adopted children under US immigration law.


my friend was 6 when her mother became a usc via naturalization because the mother married her stepfather (a usc)

and at the time the Child citizen act can into force in Feb 2001 she was 17 before that and after that,

she is living with her mother and stepfather

BUT heres the thing, she did not have a GC = LPR when she entered, they did not file papers for her only the mother...does that mean the law of derived citizenship of the CCA does not apply to her because she has no legal status.
I told ehr to apply for a u,s passport because the certificate of citizenship costs more and you wait longer!!!!
