changed due date on mortgage, please help
My mortgage co. is in the process of starting a foreclosure on my home. It has been a nightmare since we bought this house. When we finally got our payments caught up( our due date was on the 29th of the month). The mortgage co changed our due date to the 1st of the month(without our consent, they had sent me a letter to authorize the change, but I didnt sign it and return it) But they changed it on their own. When they changed it to the 1st, it automatically made me owing another payment 3 days later. I never had the funds to make 2 payments that close together, now instead of me being one or 2 months behind, they say it is 3..Please help, was it legal to change my due date like they did. Also when we refinanced our house, they held the money that should have gone to us with them. They said it was to pay for homeowners ins. After a time they took our check only about 363.00 and applied it to our account. How could they do that with a check that was made out to my husband and me?Anyone, can you please help me..

Normally that is not legal unless your agreement specifically contemplated that. Ask them to explain in writing as a first step.
You could also file a complaint with your state attorney general among others. |
