Due to an adjustable rate that I could not manage, my home was being foreclosed on. I went to a company called US Loss Mitigation and dealt with a man named Paul. This is an office of a company run by Stan Schultz out of Virginia. Paul is located in another state and I am in Indiana. After checking out the company and there being no complaints with the BBB, I decided to use them to help. They claimed to be able to save my house and after a lengthy registration process and questioning I was told I qualified for their help. They could save my house for a fee of $1500. I was told this was 100% refundable if they were unable to help me save my house. Turns out they never did anything on my behalf and I lost my house, all the while they wouldn't return a phone call. We have repeatedly called and left voicemails for Paul (who never answers) requesting our refund only to be ignored. Stan was little help saying "Good luck" basically after telling us that this guy is in pretty deep and there have been many recent complaints. So now I've lost my home which I had over $50,000 in equity in that I trusted this man to help me save AND an additional $1500. I think at the very least he needs to honor his refund policy.
My question is, what legal recourse do I have? Since he is in another state I assume I can't file a small claim against him in Indiana. Do I report him to the FBI as a foreclosure scam? Can I contact the US Attorney general? What are my options? Thanks, Frustrate |

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your and their state attorney general's office.
