Mortgage Company messed up, now I pay the penalty?!

I have just had a chapter 13 bankruptcy discharged. It seems that almost 4 years ago, my mortgage company mistakenly rolled my ahead a monthly mortgage payment. Since I was stuggling to makes payments an dsoem were not on time, I neverm picked up on the mistake, and the mortgage comapny didnt either-until they just did a payment history after the bankruptcy was discharged....

Now they rolled my payment history back to reflect 4 years of late payments!
Which has already been reported to a credit agency, and is now on my credit report! And now they are tacking on late charges to my payments since September.

Since this was their mistake, can they do that? I also am getting letters stating that I am in default.....completely u8nfair!

If I owe a payment, I am fine with that,but dont feel I should have to pay /endure penalties on their mistake.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
