Exclamation Undisclosed preexisting damage

Hi I'm doing great, but my wife's best friend and her husband have a bit of a problem.

They went house shopping and got a "good" deal on a house, got a conventional loan, then got married, and moved in. Everything was fine until 4-6 months into the house they noticed little cracks started to appear in their walls where it now seemed apparent that paint had been used to conceal it. couple more months go by and doors won't close properly and cracks are even more noticeable. More months go by and now the bathroom floor has bubbled up where a plumbing defect had been covered up. Now with a Child, one income thats JUST getting them by they are just sick of it all along with it now seems the roof has been leaking. The house seems to get worse and worse, and they are just flush right out of ideas.

Now I'm posting this because they do not have either internet nor a computer and they where wondering if there was any way they could get out of the mortgage. The seller signed the papers saying there was NO Preexisting damage, but it now apparent there is. This house was not sold as is.

Default Re: Undisclosed preexisting damage

They can sue the seller or builder for damages or even fraud but they are still obligated to the lender normally.

Thumbs Up Re: Undisclosed preexisting damage

wounderful thank-you. thats what they want to end up doing, but of cause they feel bad doing it. I told them that they really shouldn't since they sold the house with such bad foundation.
