Default Refinancing Laws in Texas

My boyfriend and I purchased a home together in May of 2006 in Houston, TX. We have since broken up and I no longer want to live with him. Neither of us want to lose the house, but he can not afford the house himself, so I was pursuing refinancing my home with just myself on the title. But I was informed by a mortgage company that there is a law in Texas that states you can not refinance within 1 year of purchasing. If this is true, is it possible to petition a court to allow the refinancing due to the situation. Also, what are my options as far as legally having my X removed from the residence, even though he has 50/50 ownership of the property.

If two or more owners cannot agree on what to do with a piece of property they may petition the court and the court will order a sale or refinancing etc. so that the one or more may get out of the property obligation and/or the other(s) may keep it etc.--it is often done--

You normally have to file a complaint in court; it helps to have a lawyer involved frankly.
