I need some help and advice. We live in northern ontario canada Two years ago we decided to sell our home and buy a variety store with attached home for 135,000.00. I called around for a mortgage broker to check on cost and found one that said no fees he was paid by the lender. We hired him then a few weeks in to the deal he wanted 599.00 I questioned this and he said I found you a mortgage so it is either 599.00 or no mortgage, but he said its been alot of work and this will be my only fee I was then told to make the cheque out to him as he was also the owner of the company. Then we need an appraisal thru our realestate agent we hired one for 800.00 every few days I would call the agent to see if the appraisal was back, finally after two weeks I get a call from a very upset agent telling me I have to make out a new cheque as he went to pay the appraisar and found out that the mortgage broker had taken it upon him self to hire someone else and we now owed 1100. for the apprisal.but it was still not ready but would be in a couple of days, but your offer to purchase is expiring today I will see if I can get an extention so he called us that night at 9pm to ask us to come to his office, we went and he said he had talked to the mortgage broker who had called his appraiser and the value was there so he recommended we sign off. I asked him what if it isn't there and he said well then we all end up in court. We signed and two days later the apprisal was back and for 45,000 less then we had offered. I flipped when the broker called and said he need another cheque for 800. he was going to hire another appraiser (the original one) I siad no I am not paying for it. The realestate agent agreed to pay it. The broker called and said the mortgage was done and he need to see us to sign papers. When we got there we started with insurance papers my husband said no I have diabetes and don't qualify. "I did not ask you any questions sign here". My husband protested Richard the broker again raised his voice and said " We are not reinventing the wheel today initial here then we will go over things." Thinking we had misunderstood the procees we initalled. Then came what looked like a standard for but was not yet filled in Richard proceeded to fill in the brokers fee 800. I said NO way you said there was no fees then you said 599. but no more now you want 800. Richard scibbled it out and wrote 1250.00 are we going to continue to invent the wheel today all your legal papers are done and in three more days you will be move I imagine everything is packed and you are legally attached to this house. Very upset we left his office. Two days later we arrived at the lawyers to get another kick in the head. We were no longer putting 20,000 from the sale of our house but 42,000 from the sale of our house and we now owed Richard in total 8127.10 in fee which included 1803.10 disbursment fees, 1050.00 Richards legal fees, 350.00 lenders fee, 1017.00 rrsp set up fee for paulette glaude (richards wife) 375.00 rrsp fee, 642.00 rrsp mortgae fee, 399.00 applic fee, 1250. broker fee plus 599. advance fee. Frantic calls were made to Richard but he was on holidays and would get back to us his son said there must be an error. He will fix it when he gets back. Stuff is on the truck what do we do so believing it was an error and would be recktified the transaction was completed. And the we had to still wait as Richard also forgot to send the mortgage money, as it turned out because of his sealing over the apprisal the bank had only agreed to mortgage us for 63,000 not 1110,00 like Richard said leaving Richard to come up with the difference, and he still could not so we found out later our realestate agent had to put 6,000 in to the deal as well and when the final papers came it was no longer 8% interest it was 12% for the money from Richard depending on which document you look at as one says 23% interest. When we were talking to our realestate agent he told us he was getting 6% interest. Then to top it all off our first mortgage payment is do to come out of the bank but RIchard has it set up that it comes out in 5 different parts so we are paying interest on all 5 parts. For a year we try to get our money back from Richard supposed errors but to no luck he won't even talk to us then we get an email from him saying our renewal is due and he would like 500. renewal fee plus 642.00 for his rrsp fees this year and I want it in 10 days or no renewal. We went to a lwayer because richard has drained us dry leaving us with no money to get the business up and running and he says it will cost 30,000 (gee Richard has my money) to go to court and he can't even tell who has my mortgage because ever document is different. The mortgage comes out of the bank TD bank, one document says Homelink financial corp, one says The mortgage Centre, one says, Canada trust company. I need help desperatley. I need a lawyer who is not going to charge me 30,000 I no longer have but who can take it out of what we win in court. I beleive this to be fraud. I did contact the police but have heard nothing back. And one last point Richards brother is a Judge.

I think you should email world law direct on their home page and ask for a lawyer to help.
They may do so for contingency, or free or some low cost. You don't need to spend 30K to bring that guy to justice. I agree you have been taken advantage of, and there are lots of ways to work on resolving that. |
