Privacy Act Issues in Writing a Book
I am writing a book about Murders in North Texas 1892-1925. At the end of
each story, I am writing a genealogy of the victim and murderer listing names of each person, their parents and siblings and their children. I am trying to give each story a more personal touch. Many stories will tell of the accomplishments and/or hardships that the families were faced with after the family member was killed or sent to prison. Seeing that the children would have been born prior to 1925, most of them born prior to 1910, the chances that they would still be alive is not likely making them 90-100 years old. If I cannot find a death date for a child, I usually have not listed them. My question is, what is my libility if a living descendant objects to the fact that I have named their dead ancestor in my book, whether it is a parent or grandparent. Can I be sued? All of my information comes from the US Census which is in public domain, or Social Security Death Records or the various state birth indexes, which are all available online at ancestry.com. This is all basic information found online to help one in doing genealogy. If it is readily available online, can I still be sued? Thank you for your help. |

You can be sued if they allege you said something factually inaccurate and you are citing it as fact.
It may be worth having counsel look over your project briefly. |
