Restricted Selling On ebay

I am a seller on ebay-I sell authentic designer label handbags. About 5 months ago, ebay restrcited my selling of these items. They refuse to tell me what the restrictions are and how long they will last saying only that \"Please understand the restrictions placed on your account are not accusations of you personally selling counterfeit items nor do they affect your standing as a valued eBay customer. The restrictions are proactive means of assisting eBay to reduce fraud and negative buying experiences on the site.\"

I receive the same form letter from them over and over and have appealed this with them many times. I am looking for help as I cant believe this is legal to interfere with my income when I have never sold a counterfeit item. Is there anything I can do? ebay does this to MANY sellers on the site, but it seems that most are intimidated or dont know how to procede to take this higher to get resolution.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior...

Anybody can report anything they want to ebay claims department. It can be some jealous competitor (ebay seller), customer or famous handbag manufacturer who finds your bags similar to theirs. Ebay will be deleting it to comply with their so called anti-counterfeit program to avoid annoying buzz and to protect itself. They are the owners of the auction platform. Some people just love to report out of boredom or to feel important. Losers. Though your supplier could have duped you to believe its authentic. Sad.

Recently, the EU has been considering a ruling that will allow brand owners to prohibit sales of their products on eBay. The question that has been raised is: are such sales in a global economy a threat to 21st century commerce, or is it simply a protection of trademarks?

If the EU rules in favor of the brands, they will be able to make a rule prohibiting their sale on eBay including brand new with tag (BNWT) items as well as second hand goods.

The root question that has been “answered” with numerous statistics on both sides is whether eBay is a worldwide marketplace for counterfeit goods.

According to brand owners whose products have been widely counterfeited, the answer is yes, and the only way to stop counterfeit goods from making their way onto eBay is to prohibit sales of their brands on the auction site altogether.

eBay believes that they have a handle on counterfeiters under their Verified Rights Owner (VeRO) program and that such a ruling would throw the baby out with the bathwater and infringe on individuals’ rights to engage in free trade using their selling platform.
