I work for a popular seafood restaurant in a resort location in South Carolina. The company that I work for is huge! They have restaurants all over the US and Canada. They are going through some financial problems, and have decided to charge their servers a .015% fee for every credit card transaction that a server transacts. It would be like working at Wal-Mart and Wal-mart charging the casheer every time a customer bought something with a credit card! I dont think this is legal, and it certainly is not ethical. If any lawyers would like to contact me about a class action lawsuit, I would be happy to provide details. Please leave me a message here

That violates the card agreement with the card company.
If you report that to visa/MC they will likely stop that from occurring. |

So if it is against the agreement with the credit card company, does that make it illegal?? I dont want it to just stop, I would like to get the money back that they have been taking, and possibly, then some.

I contacted VISA about the issue and they said they have no affilation with the bussiness that accept their cards. The institiution that holds the contract with the company that I work for is who I need to talk to. I am not sure which bank it is that we bank with, but I will find out and contact them. In the mean time, is there no lawyer on this website that wants to nail a huge company with a class action lawsuit????

I also work for a company that does this. He charges .010%, however I tallied it up and thats roughly $500 a year times 20 servers...thats a lot of money. Its completely unfair but I don't know what to do about it. Can someone help us!!

You could consult your nearest Department of Labor office to briefly discuss the issue with them first...you may also want to ask the company to put what is happening in writing and explain to them that you may have attorneys review the situation...try speaking to a higher level of management about the issue; they may override the other managers. If none of these efforts resolves the issue, let us know.
