My neighbor borrowed my van and not an hour later I got a call that it broke down. She had it towed to a mechanic and it was declared a transmission issue. She refuses to pay for the damage!!!
Does anyone know anything about this typ of situation? I live in the state of Oregon and plan to file a claim with small claims court but I don't know if I am in the wrong... Please help... Thank you! |

She is not liable unless she did something improper that caused the damage.
You would have to show she was not acting reasonably. |

Isn't it unlikely that what she did in an hour caused the transmission to blow out? I think unless you can prove some type of action on her part that caused the problem, it wasn't her fault.
