Default Neighbor borrowed car and blew it up...

My neighbor borrowed my van and not an hour later I got a call that it broke down. She had it towed to a mechanic and it was declared a transmission issue. She refuses to pay for the damage!!!

Does anyone know anything about this typ of situation? I live in the state of Oregon and plan to file a claim with small claims court but I don't know if I am in the wrong...

Please help...

She is not liable unless she did something improper that caused the damage.

You would have to show she was not acting reasonably.

Isn't it unlikely that what she did in an hour caused the transmission to blow out? I think unless you can prove some type of action on her part that caused the problem, it wasn't her fault.
