BIL not making payments on truck

About 18 months ago my hubby got an auto loan in his name for his brother.
BIL has been late several times since then. Actually, quite a few times. He lost or quit his job a couple months ago and is behind about 2 months. He won't answers calls. He has made a couple of $100 payments but several weeks apart. I check online regularly. It still shows him behind by $700.

My hubby is tired of dealing with this and just wants to go get the truck but wants to find out how best to go about it. Can we just go get it since it is in his name or what? We don't want to get in legal trouble but don't want to wait for the truck to get repossessed either.

You can take it if you are also on title. Otherwise you may have to sue for the late payments in small claims court.

Thanks. I'm hoping we can just call the finance company to see who's on the title. I'm pretty certain it's in hubby's name. He says his brother didn't sign anything.
