I am a social work student currently working on an assignment and would appreciate some legal advise on a couple of things.
1. If a 13yr old girl claimed that her 21yr old boyfriend was hitting her would this be classed as a child protection issue or domestic violence or both and what would the legalities be around this? 2. If you was suspicious that the girl of concern was having a sexual relationship with this man could a medical examination be enforced? 3. In the view of confidentiality, if consent has to be given for a medical examination do the parents have to be informed and would the responsibility of consent lie with the parents/guardian? You likely are preparing a more academic and discussion-oriented answer.
But that situation could and should be reported to law enforcement if a sexual relationship and/or abuse is evident. That would be a violation of each of the concerns you have described. If your position has confidentiality issues, your licensing board could help input and guide you. |
