depriving of lunch in school

Confused depriving of lunch in school

hello,
my 3 year old son goes to private Montessori school for the full day. In the school's schedule it states that there is 30 min lunch time and after lunch there is a hour or less (depends on the weather) time outside on the school's playground. we are bringing our own lunch to school. But with the new teacher this year, it seems that the kids are being deprived of lunch time and fresh air time if they are not finish their 'work' on time. the kids are NOT allowed to eat their lunch or go outside! I understand that Montessori Method is supposed to teach children responsibilities and independent choices. But in any case, a toddler or a preschool child will not question a teacher's word. I don't think the education of a child should be at the expense of his physical health either. My question is- is it illegal to deprive a child a lunch time period, as well as a fresh air break? Does a childcare provider has right to keep a child without lunch and 'punish' or 'educating' him that way? Please let me know the answer and also where in Education Code or some where else, can I read that. Thank you very much

Withholding lunch is generally not permissible. You could call city officials and licensing boards on that point.

She cannot withhold lunch from the child--that is illegal.
