bank took my money!

bank took my money!
A friend(or so i thought) owed me some money and he signed over his tax refund to me back in June. the bank held it for 5 days till it cleared. Well i find out today (October) the bank has taken money out of my account saying that the person who was on the cheque is stating he did not give it to me. is that legal for the bank to do? should he not have to take me to court and prove it so i can state my side? is there a statute out there that i can tell the bank to return my money? PLEASE HELP

Did he sign it when given to you.
You could take both him and the bank to small claims. |
