Colorado- my exhusband wont claim his stuff
I live in Colorado. The courts dissolved my marriage in Nov, 2011. We have been seperated for 2 years. The ex was in work release and got out on Feb 1, 2012. He has refused to come get whats left of his personal property. I paid for a storage shed and removed most of his belongings. He came over while I was at work, and picked up a 67 Mustang, which was a gift to me and he was supposed to sign over, but he took it since the title was in his name, and his footprints were all over the property. What he has left is misc tools, camping gear, mostly junk, and some non running vehicles. We have been making arrangements for him to pick his stuff up since Feb 1, but he is always a no call, no show. My only requirements were that he gives me notice he is coming to my house, and that I am present when he shows up. I own the house and property where he has left his stuff. I only have a cell number for him and he refuses any response. I have documented any contact we have had about pick ups and have witnesses. I have since sent a certified letter to his mothers, which they refused to sign for. It stated his stuff would be considered abandoned after May 7- six months from the dissolution and approx 90 days from his release. I have also posted a legal notice of abandonment in the local paper. What else do I need to do before I can have the stuff hauled off? Have I covered myself enough? I am being used as free storage. I just want his stuff GONE, and this finalized, so I can move on with my life.

I wish to inform you that you can restrict a persons right to remove in your presence and have prior information when other person is coming. Further you can have court order regarding abandoned goods and can sheriff remove the goods. You can remove things under § 13-40-122 and can claim that the status of your ex is that of an unpaid tenant after marriage and he intentionally does not remove his stuff. You can claim storage charges.

Do I have to have a court order? Can I not just have the stuff hauled off by junk haulers? I dont really have the means to pay legal and court fees...
