Default HELP

I had my children enrolled in a childcare facilty in mid Sept of 2006.
Slowly things started to happen...ie bite marks on my child repeatedly
(5times to be exact) and I had to sign incident reports - which she would
NOT give me a copy of. Then I received a letter home stating that one of
the children went missing from the centre - well right there and then, I
started to look for another childcare facility because I then felt my
children\'s lives were in danger and did not feel that this facility was
giving appropriate child care. I gave the daycare a letter April 30/2007
that the kids last day would be May 4/07. She had told me that I needed to
give her 2 weeks. I then told her that I couldn\'t, but would pay her for
that second week. She gave me an amount of $26, which I gave her a cheque
for right then and there - SHE CASHED IT and then realized that subsidywas
not covering the 2nd week and then tells me that I owe her $188 for the 2nd
week. She handed the matter over to a collection agency. I received a
letter from them in early june along with a VM from someone named \"Mrs
McCoy\" - not knowing who this person is, I returned the call and there was
no answer. This lady no is calling me at working threatening to garnish my
wages and I\'ve called her back several times and she has hung up on me? I
feel that I do not owe this money as I feel that my children\'s lives were
in jeopardy and felt that I had a just cause as well as the fact that she
gave me an amount and cashed the cheque - therefore accepting payment. I
need to know what to do from here.

Those reasons you cite are valid to cancel the agreement; you may sue her in small claims if need be.
