I have personal property which was on loan to a museum. They failed to act appropriately in returning the property and a substantial portion was destroyed. Is it better to file a suit under civil law or tort law?? Also, can emotional distress caused by their wanton carelessness be added to the suit (State of Tennessee)

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior...
