My father passed away 2-1/2 years ago. He was divorced twice at the time of his death. His car was co-owned by him and his ex-wife. He recieved the car in their divorce settlement but never removed his ex-wife's name from the title. At the time of his death he owed money to the credit union he had a loan with but he had insurance which paid off the balance when he died. His ex-wife moved out of state and she is nowhere to be found. I am his only child and received his other assets. He had no will, trust, etc. and his estate did not go through probate in california because it was small. The credit union will not release title to me since his ex-wife is on the title. They feel badly for me but do not know what to do. I asked to speak with their lawyers and the credit union will not let me. The DMV has not been helpful either. I do not know what to do and any ideas or direction would be appreciated.
Thank you. |

You have to try to locate her but if you cannot then a court can order title be given to you. If she has title as well she likely will still get half or all of the car.
