Default planning a lawsuit

I would like to inform my former employer that I plan to file a complaint with Department of Labor and go to court if we do not reach a settlement regarding my firing by a certain date. Is there anything illegal in doing this?
Appreciate any assistance regarding this matter. Thank you.

You are allowed to inform them of that. It is not illegal to do so.
