Question What can you do if a notary falsifies a document?

I contacted Patricia Hamby who works at S.C. Secretary of State as Director of Notaries and she gave me the following guidance:


The false certification by a notary public is a misdemeanor by law under SC Statute paragraph 26-1-95. You must report it to your local law enforcement agency, provide them with the above statute. Once the notary is convicted in a court of law of false certification by a notary public, the Court must notify our office at which time we are instructed to permanently revoke the notary\'s commission. Also I believe forgery is a felony which would be against the person who forged your father\'s name.

You should insist in with the law enforcement located where the incident took place. False certification by a notary public is a crime albeit a misdemeanor under the law I provided to you. This will only allow them to charge and prosecute the notary for \"False certification by a notary public.\" Punishable by not more than a $200.00 fine or 30 days in jail and the permanent loss of commission upon conviction and notification to our office from the Court.
