Default Mother allowed to keep money from 18 year old son?

I receieved money from social security awhile back when I was a minor. My mother put it in a CD in the bank at the time The money did come in MY name, and was recently released from the CD. My mother now refuses to let me have ANY of the money untill I am off to college even though I am 18. I still live with her, but is it legal for her to keep that money from me now that I am 18?

i personally don't think she can.. but on the other hand she did get it when you were younger so it is tricky. i think if she was going to use it herself she should have already used it and not put it in a bank and wait till you were old enough to know about it and tell you it was for you and then not give it to you. that is just wrong i feel. but hey.. parents are parents. so i think she should give it to you.!

If you are attending college, she can do that. If you aren't, she cannot.

You must be patient when asking questions and expecting answers. There are not actual attorneys on this message board. You posted at 12:17 in the morning and then again at 5:29.

If you feel she is being unreasonable, take her to court and tell the judge what is going on and ask that she demand the money is turned over to you. The money IS rightfully yours. NOT hers. She has no legal right to hold it hostage.

I was there when she put the money into CD. It was $4000.
The account is her name so I cant take it out. This money came from Social Security with MY name on it. It was sent to ME. I was to young at the time I recieved it to handle it responsibly which is reasonable. However I was 17 when she re-locked it in the CD. I am 18 now, and she had it released because I need that money for college. However she refuses to give me any of it untill I got out to Anaheim California. Yes I am in college, but I am currently taking online courses because she had locked up my money which made it so I couldnt get the down payment and 1st months rent on an apartment in Anaheim to goto the campus.
I fail to see how there is any reason that she can hold money back from me that was issued by the government now that I am 18. Wouldnt that be considered theft?

the above post is mine, jsut confirming, bust I also left somthing out on mistake.
She claims I cannot have the money till I head out to cali, so you may be wondering why dont I jsut go, so I can get it... well simpley enough. I need that money to fix my car.. so I can go.. I am disabled at the moment and have no other means of paying to get my car fixed..

No need to explain.

Put plainly and simply, the money is yours. She has no right to hold it hostage. You must file a claim against her in small claims court. You can do that without an attorney.

What state are you in? Small claims usually has a cap of $5000, but some states have higher or lower.

You are going to have to take that avenue, as she's made it clear she's not going to give you the money. She cannot keep it using any conditions. It's entirely your choice whether or not to even go to college, let alone which college you must attend in order to receive money that is legally yours.

The only way to resolve this matter is to sue your mother.

I live in Arkansas. and the money in the CD at the time was $4000, though it drew interest being locked in the CD. I dont know how to go about going to a small claims court without contacting an attorney. Much less I cant afford court fees
