A policeman stood up in court and told the court that my son was on heroin. My son was not there at the time. I can truly say that my son does not take heroin, he did a few years ago but is on a metadone programme since then.Can that be called Defamation.

If the Officer lied in court he can be charged with purgery. However you yourself say he use to take this drug.

Without proof, the officer cannot simply arbitrarily say someone is on drugs. For one thing, it is hearsay. If this had been a civilian, the judge would not have even allowed the testimony.
He might have committed perjury, and it matters not whether you admit he used to have a problem with it. The officer has no way of knowing for sure whether or not he still uses. And to have made that statement without your son being there to defend himself was out of line for the officer. But good luck fighting this. Cops and judges, they all stick together. You'll have a very difficult time winning defamation if you pursue this. And it really doesn't make a whole heck of a lot of difference anyway in the grand scheme of things. What happened to your son as a result of this? |

You claims the Officer has not proof, yet you make a blanket statement that cops, Judges etc stick together suggesting bias and wrong doing! You just did same thing you accuse the Officer and courts of. We do not know the wording the Officer gave in his testimony nor do we know how he arrived at that! If it was indeed false why did the Defendants Attorney not object!? ..................Oh wait I know the Defense Attorney is part of the conspiracy theory of yours!

Having worked closely in the court system, I have personally seen, and have had jokes told to me that "we boys stick together", I think I can state what I've been witness to. Judges do tend to take the word of police officers, as they are considered more credible than, shall we say, heroin addicts who have gotten in trouble with the law?
It's not a "conspiracy", and of course we have no way of knowing whether anybody objected. Your post is highly emotionally charged in nature and suggests a touch of paranoia. It has done nothing to add to the topic other than bashing another poster's comments, which is counterproductive. |
