Default Rock Band needs Advice!

Hi, I am in a rock band and looking for advice. I feel we got burned on an opportunity to play a bigger event that never happened.

Here is the scenario ...

To be considered for a major festival, we had to pay/sell $200 in tickets for an audition at a venue. If we were "liked" we would be asked to play the fesitival. We were never told if we had been accepted or not but we did get a follow up notice saying that the Festival has been cancelled for unforeseen reasons.

Becuase the event we were auditioning for got cancelled, does that mean we should get our money back????

I emailed the contact asking for our $200 back and he stated the following:

"I have no deposit from you. If the ticket money from the from the audition show is what you are referring to, that was never a deposit to play the festival. Audition shows fund the company, and partially the festival, but are not and were not ever considered a deposit to play the festival. Financially, the auditions and the festival seperate entities."

Can someone please tell me if you should just accept that we got burned and know better next time, or if based on the information I have shared that we should get a refund.

They did not follow through as they promised to do. It almost sounds fraudulent frankly.

Based on what you say here, you could file suit against them (or at least threaten to do so) in small claims court or in regular court; filing in small claims court is easier and requires no attorney...you could try to collect all of the costs and damages that you suffered due to their behavior... You may also report them to your state attorney general's office.
