dealer takes back car and won't give back down payment

Default dealer takes back car and won't give back down payment

hello everyone and thank you for your attention and comments/advice with my problem.

i have bought a car recently. all arrangements were made and a contract was drafted and signed. about one week later, the dealer wants to take back the car. their reason was that the bank did not approved the loan. we asked about the signed contract and they said that they jumped the gun to sell us the car before finish dealing with the bank. in any event, they take the car back and assured us a full refund of $6000 down payment. the car is return as requested and proper paper works are filled and signed. i still have not receive my refund to this date.

on the day the car was returned, i was told that all the finance personels are in trainning so they could not issue the check. i know they are lying but had no choice but to go home empty handed, no car and no refund. i returned the next day as agreed/scheduled and again i was dissapointed with no refund. their excuse this time was that the owner has gone home so no one is available to authorize the check. furious and knowing that they lied but i had no choice but to go home, again empty handed. i called the next day to ask for my refund but was told that the owner did not come to work that day and that because it was friday, i was told not to check with them again until monday.

i dont know why they are prolonging this since it does not seems to be benificial to either party. i do fear that they will hold my money indefinitely. i just want my money back but do not know how to pressure 'these people' to do so. i could not afford a laywer so i am resort to using the forum in hope to find helpful tips/advice. any comments/suggestion is very much appriciated.

I'm in the same scenario. Any updates or suggestions from anyone?

I'll be contacting the owner directly, by certified mail or FAX, and of course pass it on to my attorney.
