Question NYS: Negligence suit against county adult protective agency?

A county adult protective agency was fully informed about the financial abuse of an elderly couple and their daughter by three out-of-state relatives.


Those same relatives subsequently motivated a hospital to bring a Section 81, involving the elderly woman.


The county adult protective agency knew that the Section 81 was a slanderous affair, but did nothing to report it, or get it thrown out.


Against her will for four[4] miserable weeks, the elderly woman was detained by the judge, used as an instrument to do the hospital's/relatives' evil bidding.


The elderly woman -- tortured/caused to deteriorate/stressed to the hilt by hospital personnel -- was no can of beans to be put up on a shelf for weeks on end.


She'd needed to be home with her loving husband and expert, caregiving daughter.


The end result of what the adult protective agency failed to protect against resulted in the premature death of both the elderly people, and the near-death of the daughter.

Here is your biggest problem above.

If the judge made decisions the court is virtually immune and so are the agencies doing what the court asked.

Get skilled counsel to assist.

I've spoken to many attorneys already. None want to get involved.


What happened re. the adult protective agency is part of a much bigger story, hopefully to be investigated by a high-level state crime commission.


The judge can't be immune in a case like this. Judges aren't G-d, but this one was behaving as if he were, taking the fragile, elderly woman's life for granted and into his own hands.


He should've been stopped at all costs.


He will be charged with judicial misconduct, now. But there has to be much more that can be done to him. He had no concept of the elderly woman's health needs.


Many elderly patients thrive at home, but wither away in hospitals and nursing homes.


Certainly, the adult agency knew that. There was no excuse for it to sit back while the judge exploited the elderly woman's [her ill husband's and daughter's, too] situation.
