More info on mineral rights
The mineral rights I am referring to in my previous post are in colorado. The well is a natural gas well that is producing lots of natural gas. It has been sitting and producing for 14 years. Brother didn't handle mineral rights assignment to brothers, sister and nieces and nephews. My mom died years ago. Father had a trust, and he is deceased, but mineral rights are not in trust to my knowledge. I believe there is a will on my father's estate also. Does will trump trust? Will mineral rights have to probated into trust and/or will? What kind of documents will Amoco ask for from us to prove our ownership of land?

You need to have a lawyer or title company or land man review all of the documents and deeds and verify the status.
The situation you describe could result in any combination of interests. You cannot determine the status without careful review of those documents. |
