I need to know what to do in the following situation...

A friend "Jane" and I signed a 6 month lease for an apartment. When she left, her and I both signed a letter to the lease company stating any amount left of the deposit would be mailed to me at my address and if there was bill owed it would be sent to "Jane" at her address. I called the lease company today to see what the status was on the deposit. They informed me "Jane" had called in last month to have the address changed. The check for the remainder of the deposit was sent to "Jane" at the address she changed it to. The lease company said the check was made out to both her and I. "Jane" and I are no longer friends. We are no longer speaking.

First I am worried that she wil cash the check without my signature or she will forge my signature to cash it. What should I do if the check is cashed without my signature or if she forges my name?

Secondly I feel the lease company was in the wrong to make the check out to "Jane" and mail it her. If she cashes the check are they responsible?

You can sue her in small claims or even file fraud and theft charges if need be.

It may be hard to hold the company 100% liable. Better to focus on her.
