Roofing Contract
We had a roofer come out to give an estimate on our roof on May 9th and he said it had hail damage and we should call our insurance agent. We did, 11 days later (May 20th), an adjuster came out and said we would get a new roof.
When the roofer came out on May 9th, he had a blank contract, with the caption are filled out and nothing else. At the bottom was a "ACCEPTANCE OF PROPOSAL" which says: "This proposal becomes the legal and binding contract 72 hrs. from date of acceptance, etc. etc.... "failure to pay can constitute a mechanical lien filed against the property...etc." The contractor had my husband sign at the bottom. The caption was dated May 9th, but the rest of the contract, including work to be done and the proposed amount to be paid to the contractor, wasn't filled out until May 20th. There was no date after my husband's and the contractor's signatures at the bottom of the page. My question is: is the contract legally binding 72 hours after my husband signed the blank contract (except caption) on May 9th, or is it legally binding after the contract was filled out on May 20th? THANKS FOR ANY HELP YOU CAN GIVE ME. |

It has to be a fully agreed and binding agreement.
Signing a blank page is not an agreement. |
